RIGHT OF WITHDRAWAL

1 You have the right to withdraw from the contract concluded with the Seller, without any penalty and without giving any reason, within fourteen (14) days from the day on which you receive the Products purchased on the Website. In certain specific cases, duly indicated in the Right of Withdrawal section, it may be possible to exchange the chosen product for another one.

2 To withdraw from the contract, you must draft and complete the Return Form in all its parts (request it via WhatsApp or email) and send it to the Seller by writing to the following email address: info@rattatanshop.mt

3 Once you have exercised your right of withdrawal from the contract, you must return the Products to the Seller by handing them over to the courier for shipment within fourteen (14) days from the date on which you informed the Seller of your decision to withdraw from the contract.

4 The only costs borne by you are those for returning the purchased Products, unless the Seller has expressly exempted you from such costs at the time of purchase and provided that you use the carrier indicated by the Seller.

5 If you decide to use the carrier indicated by the Seller, you shall bear the return shipping costs for the purchased Products.

6 If you decide to use a shipping method other than the one indicated by the Seller, you shall still personally bear the return shipping costs for the purchased Products.

7 The Right of Withdrawal, in addition to compliance with the terms and methods described in the previous points, shall be considered correctly exercised only if all of the following conditions are also fully met:

a. the explicit declaration of your decision to withdraw from the contract must be correctly completed and sent to the Seller within fourteen (14) days from receipt of the Products;

b. the Products must not have been used;

c. the identification code must still be attached to the Products;

d. the Products must be returned in their original, intact packaging;

e. the returned Products must be handed over to the carrier within fourteen (14) days from the date on which you informed the Seller of your decision to withdraw from the contract;

f. the Products must not be damaged.

8 If the Right of Withdrawal is exercised in accordance with the methods and deadlines indicated in this paragraph 7, the Seller shall refund any amounts already received for the purchase of the Products, according to the methods and deadlines provided.

9 The amounts will be refunded to you as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal. We will activate the refund procedures once the correct fulfilment of the terms and conditions indicated above has been verified, as stated in paragraph 8.

10 If the methods and deadlines indicated for exercising your right of withdrawal are not complied with, you will not be entitled to a refund of the amounts already paid to the Seller. Within 14 days from the sending of the email informing you that the return has not been accepted, you may choose to have the Products returned to you, at your own expense, in the condition in which they were returned to the Seller, by informing the Seller according to the methods that will be communicated to you. Otherwise, the Seller may retain the Products, as well as the amounts already paid for their purchase.

If the conditions set out in the previous paragraph 7.7 are not complied with, you will not be entitled to a full refund of the amounts already paid to the Seller. You will, in fact, be responsible for any decrease in value of the returned Products resulting from use other than that authorised by the Seller for the purpose of allowing you to ascertain the nature, characteristics and functioning of the Products themselves. In this case, a percentage ranging from 10% to 90% of the amounts paid by you to the Seller for the purchase of the returned Products will be deducted from the refund, as will be specifically communicated to you by the Seller via email. Within 14 days from the sending of the email informing you of the amount deducted from the refund, you may choose to have the Products returned to you, at your own expense, in the condition in which they were returned to the Seller, by informing the Seller according to the methods that will be communicated to you. Otherwise, the Seller may retain the Products and an amount corresponding to the percentage deducted from the refund.

REFUND TIMES AND METHODS

1 After the return of the Products, the Seller shall carry out the necessary checks regarding their compliance with the conditions and terms indicated in paragraph 7.

If the checks are successfully completed, the Seller shall send you, by email, confirmation of acceptance of the Products thus returned.

If the checks are not successfully completed, the Seller shall inform you, by email, of the existence of a decrease in value of the returned Products resulting from your failure to comply with the conditions indicated in the previous paragraph 7. At the same time, the Seller shall also inform you of the amount that will be deducted from the sums paid by you for the purchase of the returned Products, without prejudice to the alternative possibility of having the Products returned to you, at your own expense, in the condition in which they were returned to the Seller, as provided for in the previous paragraph.

2 Regardless of the payment method used by you, the refund, whether full or partial, shall be activated by the Seller as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, subject to verification of the correct exercise of your right of withdrawal and inspection of the returned Products.

3 The Seller shall issue the refund using the same payment method used by you for the purchase of the returned Products, unless you have expressly agreed with the Seller to use a different payment method and provided that you do not incur any additional costs as a result of the refund. If the recipient of the Products indicated in the order form is not the same person who made the payment for their purchase, the refund of the amounts, in the event of exercise of the right of withdrawal, shall in any case be made by the Seller to the person who made the payment.

4 The value date of the re-credit shall be the same as the debit date; consequently, you will not suffer any loss in terms of bank interest.

5 The Seller reserves the right to indicate the carrier for the return of the Products following any return request. By using the pre-printed adhesive label attached to the package containing the Products, you may return the Products to the Seller.

6 If you decide to use a carrier other than the one indicated by the Seller for the return of the Products, you shall bear the necessary shipping costs and shall remain responsible for any loss or damage to the Products during transport, according to the methods and terms provided for the exercise of the right of withdrawal.

7 All shipping costs already incurred at the time of purchase and any extra shipping-related services, such as scheduled delivery, delivery to the floor, insured shipping, gift wrapping and the cost of the cash-on-delivery payment service, are excluded from the refundable amount.
